General Terms of Sale
CREO Positano Glasses di Crescenzo Parlato, sole proprietorship, VAT IT05475940655, tax code PRLCSC86R29I862E, REA SA 451697, with registered office in Positano (SA), Via Cristoforo Colombo 163/A, 84017, Italy (“CREO”), owns the website creopositano.com (the “Website”) and uses it to sell sunglasses and prescription frames and glasses, lenses, cases and accessories.
By making a purchase on the Website, the customer (“Customer”) accepts these General Terms in full. CREO undertakes to comply with them and to keep the current text always available to the Customer.
Some provisions apply only to a Customer who is a Consumer, meaning a natural person acting for purposes outside any business, commercial, craft or professional activity they may carry out (Article 3 of Legislative Decree 206/2005, the Italian Consumer Code).
1. Conclusion of the contract
1.1 An online sales contract means a distance contract for movable goods, concluded between CREO and the Customer within a sales system organised by the supplier, using exclusively means of distance communication.
1.2 The presentation of products on the Website is not an offer to the public but an invitation to the Customer to make a purchase proposal.
1.3 The Customer adds products to the cart, fills in every part of the order form and pays the amount shown.
1.4 Before completing the order, the Customer sees a summary page with products, quantities, unit and total price, shipping costs, any duties and taxes, billing and delivery details, and can correct any input error.
1.5 By clicking the confirm and pay button, the Customer sends the order, which counts as a purchase proposal, and makes the payment.
1.6 The contract is concluded when CREO sends the order confirmation to the e-mail address provided by the Customer. The confirmation summarises the order details, these General Terms, the information on the right of withdrawal and, where the right of withdrawal does not apply, a statement of that exclusion.
1.7 CREO shows product availability on the Website. If an ordered product is not available, CREO informs the Customer within two working days and refunds the full amount paid.
2. Prices and promotions
2.1 Prices on the Website are in euros and include VAT at the statutory rate.
2.2 The applicable price is the one published on the Website when the order is sent. Adding a product to the cart does not guarantee that its price will not change.
2.3 CREO checks that the price is correct when it receives the order. In the event of an obvious error, CREO informs the Customer immediately; the Customer may confirm the order at the correct price or cancel it with a full refund.
2.4 Discounts and promotions are valid under the conditions and within the periods stated on the Website and apply to orders sent before they expire.
3. Accounting and tax documents
3.1 CREO issues accounting and tax documents based on the details provided by the Customer in the order form or in their account.
3.2 The Customer guarantees that the details provided are accurate and takes responsibility for them.
4. Payment methods
4.1 The Website accepts credit and debit cards through Shopify Payments, PayPal and the digital wallets active at the time of the order (Shop Pay, Apple Pay, Google Pay). The up-to-date list of methods is shown at checkout.
4.2 Payment details are transmitted in encrypted form directly to the payment service provider. CREO never has access to the Customer’s card details.
5. Delivery
5.1 Delivery is made to the Customer’s address by express courier. Processing times, delivery times and costs are set out in the Shipping policy, which forms an integral part of these Terms.
5.2 If delivery is delayed, CREO informs the Customer, who may grant an additional period or terminate the contract and obtain a full refund.
5.3 The Customer must check that the parcel delivered is intact. If there is external damage or tampering, the Customer should sign the courier’s delivery note with a written reservation and inform CREO within seven days.
6. Legal guarantee of conformity, repairs and spare parts
6.1 The legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code applies to Consumers. Goods purchased are covered by the legal guarantee of conformity for two years from delivery. The legal guarantee remedy is free of charge for the Consumer.
6.2 CREO is liable for any lack of conformity that becomes apparent within two years of delivery. The right of action expires twenty-six months after delivery.
6.3 There is a lack of conformity when the product is not fit for the purposes for which goods of the same type are normally used, does not match the description or sample, or does not have the qualities and performance the Consumer can reasonably expect.
6.4 In the event of a lack of conformity, the Consumer is entitled to have the goods brought into conformity free of charge by repair or replacement and, under the conditions laid down by law, to a price reduction or termination of the contract.
6.5 Repairs and spare parts. CREO frames can be repaired. Even outside the guarantee, and for the whole life of the product, CREO replaces hinges, temples, nose pads and screws, re-laminates the front and replaces lenses in its Positano workshop, on quotation. There is no time limit after which a pair of CREO glasses can no longer be repaired. To request a repair, simply write to creo@positanoglasses.com.
6.6 For Customers who are not Consumers, the warranty against defects in the goods sold under the Italian Civil Code applies.
7. Right of withdrawal
7.1 The Consumer has the right to withdraw from the contract, without giving any reason, within fourteen (14) days from the day on which the Consumer, or a third party other than the carrier designated by the Consumer, acquires physical possession of the last item of the order.
7.2 How to exercise the right of withdrawal. The Website offers an electronic withdrawal function, available at any time from My account → Orders. Once the order is open, the Consumer finds the “Request return” command if the order has already shipped, or “Cancel order” if it has not yet shipped: both count as exercising the right of withdrawal. Customers who bought without creating an account can reach it through the link in the order confirmation e-mail, or by entering the account area with the code sent to their e-mail address. The function asks for the necessary details and requires a separate confirmation; at the end the Consumer automatically receives an e-mail confirmation showing the date and time of the declaration.
7.3 The Consumer may also exercise the right of withdrawal by any other unequivocal statement, sent to creo@positanoglasses.com or by post to CREO Positano Glasses di Crescenzo Parlato, Via Cristoforo Colombo 163/A, 84017 Positano (SA), Italy, including by using the model form in Annex I, Part B, of the Italian Consumer Code, reproduced in the Withdrawal, returns and refunds policy. The burden of proving that the right of withdrawal was exercised is on the Consumer.
7.4 Products excluded from the right of withdrawal. Under Article 59(1)(c) of the Italian Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. At CREO this exclusion covers the following, and only the following:
- glasses made with the “Create your CREO” configurator, whose shape, lens width and measurements are defined by the Consumer;
- glasses with a personalised engraving of a name, a date or a text chosen by the Consumer;
- glasses fitted with prescription lenses made to the Consumer’s prescription.
The exclusion is shown to the Consumer before purchase, on the product page and in the order summary, and is repeated in the order confirmation.
7.5 All other products carry the full right of withdrawal. The fact that a catalogue frame is made by CREO after the order is received, and is offered with a choice of lens colours or predefined materials, does not make it goods made to the consumer’s specifications: the fourteen-day right of withdrawal applies in full.
7.6 Effects of withdrawal. The Consumer is entitled to a refund of all payments made, including standard delivery costs, except for any additional costs resulting from the choice of a type of delivery other than the least expensive one offered by CREO.
7.7 Returning the product. The product must be returned intact, with all accessories and in its original packaging, within fourteen (14) days of notifying the withdrawal. The Consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
7.8 Cost of returning the goods. Under Article 57(1) of the Italian Consumer Code, and as expressly stated here before purchase, the direct cost of returning the goods is borne by the Consumer. Returning the goods by hand at the Positano shop, Via Cristoforo Colombo 163/A, is always free. No return cost is due from the Consumer when the product has a lack of conformity: in that case the legal guarantee under Article 6 applies and all costs are borne by CREO.
7.9 Refund. CREO refunds within fourteen (14) days of receiving the withdrawal statement, using the same means of payment used for the initial transaction, unless otherwise agreed and at no cost to the Consumer. CREO may withhold the refund until it has received the goods back or until the Consumer has supplied evidence of having sent them back.
7.10 In the event of withdrawal from a purchase that entitled the Consumer to free gifts or promotional conditions, the goods received as gifts must also be returned, or their value is deducted from the refund.
8. Governing law, dispute resolution and jurisdiction
8.1 These General Terms are governed by Italian law. This choice does not deprive a Consumer resident in another country of the protection afforded by the mandatory provisions of the law of their country of residence.
8.2 Before going to court, the Consumer may use the alternative dispute resolution procedures provided for by Articles 141 et seq. of the Italian Consumer Code. CREO’s e-mail address for handling complaints is creo@positanoglasses.com.
8.3 If the Customer is a Consumer, disputes relating to these General Terms fall under the exclusive jurisdiction of the court of the place where the Consumer resides or has elected domicile, if located in Italy.
8.4 If the Customer is not a Consumer, the Court of Salerno has exclusive jurisdiction over the same disputes.
9. Liability
9.1 The Customer is liable for any breach of these General Terms and undertakes to indemnify CREO against any resulting harm.
9.2 CREO is not liable for damage resulting from the Website being unavailable, service interruptions or events not attributable to its conduct, without prejudice to the Consumer’s mandatory rights.
10. Changes and validity
10.1 The General Terms in force when the order is sent apply, unless later changes are more favourable to the Customer.
10.2 CREO may change these General Terms; changes take effect from their publication on the Website and do not apply to orders already sent.
10.3 If any single provision is invalid, the validity of the others is not affected.
11. Minors
11.1 The Website is intended for adults. Products intended for minors may only be purchased by an adult.
12. Contact and complaints
12.1 For information and complaints the Customer can:
- call +39 339 3174554;
- write to creo@positanoglasses.com;
- use the “Contact” form on the Website;
- send a letter to CREO Positano Glasses di Crescenzo Parlato, Via Cristoforo Colombo 163/A, 84017 Positano (SA), Italy;
- write to the certified e-mail address (PEC) parlatocrescenzo@pec.studiomilano.it.
12.2 CREO replies to complaints within five working days.
13. Processing of personal data
13.1 CREO, as data controller, processes the Customer’s personal data in accordance with Regulation (EU) 2016/679 and the Privacy policy published on the Website, to which reference is made. The use of cookies and similar technologies is described in the Cookie policy.
